Document, gift and car key as different legal bases

Documents, ownership transfer and insurance

Gift, power of attorney or sale of a vehicle: three different things that often get confused

A power of attorney grants authority, a gift transfers without payment, and a sale transfers for an agreed price. One paper cannot safely play all three roles.

In short

A sale transfers a vehicle for a price, a gift transfers it without payment, and a power of attorney authorizes someone to take certain actions and does not in itself necessarily transfer ownership. Before choosing a document, be clear about what you actually want to achieve and check the tax and administrative consequences.

Sale: the vehicle passes for an agreed price

A sale contract should record who is selling, who is buying, which vehicle is involved and what the price is. It is the basis for the next steps in changing ownership, but the procedure is not finished by the signature alone.

If the money is not handed over immediately or is paid in installments, the terms must be clear. A vague verbal agreement about money is a frequent source of later problems.

Gift: no price, but legal and tax consequences

With a gift, the owner transfers the vehicle to another person without payment. It is not a sale at a symbolic or undisclosed price. The relationship between the giver and the recipient can affect the obligations, so they should be checked before certification.

The document should reflect what the parties really intend. Choosing the wrong form just because it looks simpler can complicate later registration of the change.

Power of attorney: the right to act in someone else's name

A power of attorney sets out who may take which actions for the owner. Its scope must be clear enough for the task being completed. A general sentence may not be enough for a particular institution or procedure.

The most important thing to understand is that using a vehicle and having the right to complete paperwork are not the same as acquiring ownership.

How to choose without improvising

First answer whether there is a price and whether ownership should pass permanently. Then establish who will personally complete the procedure. Only then choose the contract or authorization and check its content.

Three things to remember

  1. 01

Choose the document according to the real relationship, not the shortest route.

  2. 02

A power of attorney is not automatic proof that the authorized person has become the owner.

  3. 03

Check tax and administrative consequences before certification.

Straight answers

Does a power of attorney mean the car is mine?

Not necessarily. A power of attorney authorizes certain actions, while ownership is transferred on an appropriate legal basis and recorded through the prescribed procedure.

Can a vehicle be given to a family member?

Such a legal basis may exist, but before signing you should check the form of contract, the documents needed and any tax consequences for your specific relationship.

Who checks the text of the document?

For legal certainty in a more complex situation, consult a notary or a lawyer. The inspection administration office can confirm what it needs for the part of the procedure it carries out.
